Automobile Total Loss (Write-Off)

After an automobile accident that involves injury or damage to property, you must make a report to your insurance provider within 7 days of the incident. If this is not possible it is your responsibility to report it as soon as possible, afterward. Otherwise, you risk being denied coverage.

When calculating payment for a total loss claim the insurer determines the ACV (actual cash value) of your automobile. This means the amount that it costs to replace your automobile with one of the same make and model, based on age, condition, modifications/upgrades, mileage and retail prices in your area.

If repairing the automobile costs more than the actual cash value (minus the deductible in your policy) the insurance provider is supposed to pay you the amount it would cost to replace your automobile. Just as you have the incentive to get the fair and maximum payout for your claim your insurance company has the incentive to pay you as little as possible.

It is your right to dispute the amount that your insurance carrier comes to when calculating your total loss payment. As well, in certain cases, if you have received some payment from your insurance company you are still entitled to challenge the amount of their total offer. Policies vary from company to company and are sometimes hard to understand. It is your right to engage an insurance adjuster, appraiser or lawyer to help you get a fair settlement.
